    IP Law for Video Game Developers

    With Dave Murphy, Esq. and Omar Abdelwahed


    This workshop will focus on video game law from the perspective of an independent developer. We will cover legal issues related to game creation and protection as well as the developer/publisher relationship. Specifically we will discuss IP creation, registration, and protections, employment and independent contractor agreements, works made for hire, and major provisions in a publishing agreement. Also valuable for creative artists who want to sell their music, art, designs, etc. into the video game market.

    Presenters: 
    Dave Murphy, Esq. is an intellectual property and entertainment law attorney. He focuses on business formation, contract negotiation and drafting, intellectual property licensing, and trademark and copyright law for artists and companies in the video game, music, film, television, and internet media spaces. Dave is a California Lawyers for the Arts panel attorney and Modest Means Incubator Program selectee.

    Omar Abdelwahed is a producer, engineer and writer and currently the VP of Engineering at Mighty Play, a game studio in San Francisco. Omar has more than 15 years experience leading teams for large video game publishers including Ubisoft and 2K; social games startup, PLAYSTUDIOS; and retailers such as Best Buy and Musicland. Omar's work includes the free-to-play shooter, "Ghost Recon Online", and the biggest NBA video game franchise, "NBA2K". Omar recently founded the independent games developer, Agent Disco, and has published his first mobile game, "The Null Society".

    Getting it Right with Your Live Performance Project: Agreements & Copyright Law
    with Kanika Corley, Esq. and Gordon Firemark, Esq.

    Program Description: 
    Live performance covers a wide range of art forms – theatre, stand-up, improv, music, magic, cabaret, performance art etc. Join CLA and attorneys Kanika D. Corley and Gordon Firemark for an explanation of live performance contracts and some of the the legal issues surrounding them. This workshop will explore performer agreements, booking agreements, and engagement agreements and will touch on safeguards to ensure performers get paid, and what to do when confronted with safety concerns or other day-of-show problems. Finally, this workshop will provide an overview of copyright law and copyright issues that are particularly important in the live performance context.

    Presenters:

    Kanika D. Corley, Esq. is an attorney in the Los Angeles office of Sedgwick LLP, where she practices in the areas of entertainment and intellectual property law. She is the author of recent articles about the applicability of intellectual property protections for jokes and other comedic material.

    Gordon Firemark, Esq. - For the past 22 years, Firemark has devoted his law practice to the representation of creatives and businesses in the fields of theater, film, television and new media. He teaches Theatre Law at Southwestern University School of Law and occasionally produces small cast musicals, cabaret shows and regional tours.

    An Overview of Copyright Law for Creative Artists

    Understanding the basic principles of copyright law is important to nearly all creative artists, especially in the digital age. What does it mean when something is copyrighted? Who owns copyrights? What is the difference between copyright and trademark law? Join California Lawyers for the Arts and attorney Melissa Dagodag for an introduction to copyright law. The program will answer all of these questions and provide a framework for understanding copyright protections and terminology such as "fair use" and "work-made-for-hire."

    Melissa K. Dagodag, Esq. - Melissa K. Dagodag is a native of California and completed her B.A. and M.A. at Stanford University. After earning her J.D. from UCLA School of Law in 2000, Melissa worked as an attorney at Manatt, Phelps, and Phillips, LLP, then in-house as Vice President of a small music publishing company (Palan Music, later purchased by MCS), and as Business Affairs Counsel at fashion company BCBG. Melissa is a member of the California State Bar Association, the Beverly Hills Bar Association, Stanford Professional Women of Los Angeles, and Stanford Ideas and Connections Network.     Fakes, Forgeries &
    Other Legal Issues in Art Authentication

    Program Description:

         Forgeries are often the stuff of mystery novels, sensational news stories and detailed art historical research. But what legal issues are involved when there is a question about who is the true creator of a work of art? And whose interest is at stakeundefinedthe artist's, the collector's/owner's, the public's?
         Join CLA and art lawyer Christine Steiner for a discussion of the diverse legal issues surrounding the authentication of artwork, including warranty obligations, criminal proof elements and other matters. Steiner will highlight the rights, obligations and causes of action when fakes and forgeries are discovered as well as the crisis in liability for opinions by appraisers, scholars, and other authenticators.
         The program will begin with a guided exhibition tour at the Hammer Museum, followed by the MCLE/lecture portion of the evening.  This program is designed for an attorney audience but all members of the community are welcome.


    Presenter:
         Christine Steiner is Special Counsel at Sheppard Mullin in Los Angeles. She represents art collectors, national and international living artists, collectors' and artists' estates and foundations, galleries, museums and cultural organizations, creative businesses, universities, writers, publishers, and other creative clients.
         Prior to joining Sheppard Mullin, Ms. Steiner created an international private practice dedicated to global issues in art, architecture, culture, museums and intellectual property law. Prior to private practice, she served as Secretary and General Counsel of the J. Paul Getty Trust, and as Assistant General Counsel of the Smithsonian Institution. 
         Ms. Steiner is an adjunct professor of law at Loyola Law School and has been a visiting professor of international art law in various international law school programs. She serves on the editorial board of the Copyright Society of the United States, and is active in the arts in Los Angeles.
