    Photography and the Law

    With Paul Menes, Esq.

    The legal issues affecting photographs and the photographers who take them are different than for other types of original works. The growth of social media, paparazzi, and "entertainment news" sites, television shows, and magazines has raised additional issues about photos that people shoot and how they can be used. This workshop will provide a primer on the various legal issues involved with photos and how these issues differ based on how photos are used. Topics will include: the rights of copyright that apply to photos; who owns a photo - the photographer, the person or company that commissioned it, or the subject of the photo; when "fair use" can apply to how a photo is exploited; the types of contracts that generally cover the taking and use of photos; how California's rights of publicity laws affect photos of celebrities and public figures.

    Paul Menes, Esq. is the founder of Menes P.C. He practices entertainment, digital media and branding law, using a macro, business-oriented perspective in representing clients in North America, Japan, Asia and Europe on varied entertainment business, technologies, trademark and related matters involving all manner of content in traditional media, mobile and online.     PresenterUduak Oduok, Esq. has a passion for law and fashion, and an extensive experience as a trial lawyer litigating a wide variety of issues in both civil and criminal law; and almost two decades of first hand knowledge and experiences that are as diverse as they are deep in the fashion and entertainment industries (modeling, fashion retail, fashion production, public relations, journalism, and publishing).

    She has counseled a range of clients from musicians, models, actors and actresses to designers on numerous areas of the law including contracts, business law, fashion and entertainment law, copyright, trademark and intellectual property law.

    Uduak earned her B.A. in Speech Communications, with honors, from San Jose State University, with a minor in philosophy. She attended both Georgetown and UC Hastings School of law, obtaining her Juris Doctorate (J.D.) in 2001 from UC Hastings College of the Law.

    She is also the founder and publisher of Ladybrille Magazine, the first ever publication focused on bringing African fashion and entertainment to the Western masses, Ladybrille. In 2008, her effort was recognized with a feature in the prestigious American Bar Journal. Recently (2010) Uduak was nominated for the Africa Fashion International Africa Fashion Awards for her, “Outstanding Contribution to Fashion Communications.” In 2012 Uduak was nominated as 'Media Personality of the Year' at the 7th Annual Nigeria Entertainment Awards in New York.

    The Real Deal in Reality T.V.

    Program Description:

    Join CLA for an exciting dialogue with Rob Rader, General Counsel, Ovation, and William Morris Endeavor reality TV agent Ryan McNeily about negotiating reality TV deals. Both speakers will share their perspectives on current hot button issues facing reality television production deals. Topics will include some of the key considerations that attorneys must be aware of when their clients embark on their first reality television production, special issues involving new media, and financial and other matters. This program is designed for an attorney audience, but all members of the community are welcome.


    Presenter:
    Rob Rader is General Counsel at Ovation, America’s only arts cable network distributed in over 50 Million households. Prior to Ovation, Rader spent nine years at MGM as Vice President of Business Affairs where he helped run business affairs and operations for numerous departments, including the $1.2 billion home entertainment division. He also worked for seven years at the major law firms Mitchell, Silberberg & Knupp and Morrison & Foerster before joining a boutique digital media and entertainment firm as a name partner. He is highly active in public service, including service as an elected Trustee and Vice Chair of Santa Monica College as well as a member of the Board of Directors of the KCRW Foundation and Downtown Santa Monica Inc. He holds A.B. and J.D. degrees from Harvard as well as an M.A. in sociology from Stanford. He frequently speaks to the media and at industry events and is an adjunct Professor of Law at Pepperdine Law School.

    Ryan McNeily is a television packaging agent at WME where he has been working for 5 years. His focus is representation of high end Executive Producers, production companies and personalities. His Executive Producers clients have credits ranging from “Big Brother”, “Real Housewives”, “@Midnight”, “Dancing with the Stars”, “Shark Tank”, “The Taste” and more. He works with TV talent from shows like “Always Sunny in Philadelphia” and “Grey’s Anatomy” as well as chefs, digital talent and best-selling authors. He has created a niche business within WME migrating Canadian producers into the US market. He is a former Board Member of JHRTS. He received his Bachelor’s degree from the University of Illinois, Champaign-Urbana.

    Writing Courtrooms: How to Write Courtroom Scenes for Novels, Movies & T.V. Without Making Your Characters Sound as if They Never Set Foot in Law School
    with Charles B. Rosenberg, Esq.

    Program Description: 
    In this program we'll look at what really happens in courtrooms, from jury selection, opening statements and cross-examination to objections, closing arguments and appeal. And we'll talk about how great lawyers and judges actually behave, and how their behavior impacts who wins and who loses. But we won't just criticize current TV, movies and novels for getting it wrong (which they often do). Instead you'll learn how to take the reality and mine it for even better drama.
      
    Presenter:

    Charles (“Chuck”) Rosenberg is the author of two best-selling legal thrillers, DEATH ON A HIGH FLOOR and LONG KNIVES (Thomas & Mercer). Prior to starting to write novels, Chuck was the credited legal script consultant to four of TV's most popular legal shows: The Paper Chase, L.A. Law, The Practice, and Boston Legal. He is also the author of THE TRIAL OF O.J.: HOW TO WATCH THE TRIAL AND UNDERSTAND WHAT'S REALLY GOING ON (Publishing Partners) and was a full-time on-air legal analyst for E! TV's coverage of the O.J. Simpson criminal and civil trials. Chuck has taught many law school courses on legal procedure and other subjects. He is a graduate of Antioch College and Harvard Law School.

    Bookkeeping Basics for Creatives
    with Ernest F. Howard, CPA

    Program Description: 
    In this program, CPA Ernest Howard will explain basic accounting terms and concepts for the practical life of a creative artist. The class will provide an overview of some key accounting principles as well as a step-by-step guide to the bookkeeping process. Some topics to be covered include the various options for tracking funds, from simple envelope systems to more formal computer programs and the tensions between the desire to minimize taxes and still maintain sufficient income to qualify for loans and other opportunities. Creative artists will leave with a better understanding of how to manage their personal books and finances to ensure their arts business is in order.

    Ernest F. Howard, CPA has been in practice since 1978, offering a full range of accounting, tax, business consulting and bookkeeping services, as well as aggressive tax planning and tax-audit defense. Howard is also a part time Accounting Instructor at CSU, Dominquez Hills and part time instructor at Golden Gate University (Los Angeles Campus). He has been the chairman of the Hollywood/Beverly Hills Discussion Group of the California Society of CPAs for 28 years and in that capacity plans weekly CPA education meetings featuring many of the top tax and accounting experts in America.
