    Art Law: Education and Conference

    Art Law Education: How to Craft a Law Practice for the Art World
    [14 Cal. Participatory MCLE credits available*] 

    This intensive education program is specifically designed for lawyers and art-world professionals with legal experience who are serious about providing high quality, informed representation for clients with art world matters. The program provides practitioners, regardless of their legal background, with the practical knowledge and working tools to effectively represent clients in the art world and to build a strong art law practice.

    Sotheby’s Institute of Art faculty and guest lecturers offer expert instruction on a wide array of legal topics to a select group limited to to 20 participants.

    Day 1 sessions cover on transactional basics from intellectual property to contracts and business entities.

    Day 2 sessions cover art as a financial instrument, estate planning, tax, and real estate.

    Day 3 sessions examine the role of art in an international context with a focus on cultural property considerations and restitution matters.

    Participants have access to top practitioners in the field, receive exclusive access to art world events during the course of the program, and have the opportunity to participate at a special rate in the Conference that follows the education program.

    Art Law Conference: The Practice of Law in the International Art World

    This two-day conference gathers together top attorneys and professionals to engage and debate the way that the law is actually encountered and practiced in the international art world.

    From estate planning and tax guidance to intellectual property to critical decision-making skills, the conference offers fresh insight into the areas of legal and business practice from top professionals with years of experience working with art world clients at the highest levels.

    Evening events with internationally known artists and art world personalities and unique art world experiences are included in the programming.

    CLA is a State Bar of California approved MCLE provider.  If you wish to receive credit in another state please contact Sotheby's Institute of Art immediately. We will do our best to assist you in obtaining credit in states other than California as long as there is sufficient time prior to the program dates to obtain approval. Otherwise, it will be your responsibility to check with your State Bar Association to determine whether this program is eligible and whether you may petition for approval of credits.

    California Lawyers for the Arts: Illinois Financial Hardship Policy

    Registration fee waivers to attend California Lawyers for the Arts’ education programs are available to members of the Illinois bar with demonstrated financial hardship.

    To apply, applicants must submit a request in writing that includes:

    1) an explanation of the applicant's reasons for wanting to attend the program;
    2) proof of income or explanation of financial hardship; and
    3) confirmation of Illinois bar membership.

    This request must be signed by the applicant, submitted via email, fax, or mail and received by CLA at least 15 days before attendance at the program. All requests are subject to there being space available in the program at the time the request is received. Requests must be submitted to:

    For programs costing under $500, CLA may waive part or all of the program fees in its sole discretion based on the submission received. Factors that CLA will consider in reviewing a request include the strength of the applicant's reasons for wanting to attend the program and the relationship of those reasons to CLA's mission, the significance of the financial hardship, and any prior grants of financial assistance to the applicant.

    For programs costing over $500, a fee waiver of 50% or greater is available to members of the Illinois bar who follow the submission guidelines listed above and meet the following criteria: 1) Attorneys with a demonstrated annual income of below $40,000 will receive a fee waiver of 50%; 2) At CLA's sole discretion, additional fee waivers of greater than 50% may be available to attorneys who are not currently employed. Attorneys must state in their application whether they are seeking a fee waiver greater than 50% based on employment status.

    Fee waivers do not include reductions in meals, lodging, or travel costs associated with the course. For the January 2015 Art Law: Education and Conference programs presented in collaboration with Sotheby's Institute of Art, the number of financial hardship fee waivers (whether partial or full) is limited to: two (2) recipients for Art Law Education: How to Craft a Law Practice for the Art World component; and five (5) recipients for the Conference: The Practice of Law in the International Art World component. Applications will be reviewed in the order in which they are received and remain subject to there being space available in the program at the time the request is received.

    Protecting Creativity: Collaboration Agreements
    with Carol T. Contes, Esq.

    Program:
    People collaborate at all stages of development and production, but writers especially need to know the ins-and-outs of protecting their work product, particularly when they collaborate on the creation of "ideas," writing of scripts and pitching to producers. Learn how the basics of copyright law works when writers don't have collaboration agreements, the benefits of having an agreement in place before starting to work as well as how to approach things "after the fact."

    Presenter:
    Carol T. Contes (Contes Law Corporation) has worked in the entertainment industry for more than 20 years and has provided counsel to content producers of film, television and digital programming. Prior to being in private practice, Carol has worked within corporate-Hollywood at SAG-AFTRA and various production companies including ABC Television, Paramount, Turner Entertainment and Electronic Arts in Northern California. She presently represents independent producers (as well as individual artists) routinely working in the international marketplace. Carol has taught entertainment law and business practices at San Francisco's Academy of Art University and received her law degree at the University of Arizona.

    Protections for Visual Artists: An Overview of Moral Rights Laws in California
    w/ Daniel Zohar, Esq.

    Program Description

    Join CLA and Daniel Y. Zohar, Esq. for a program providing an overview of moral rights laws that allow artists to protect their art from being destroyed or defaced. Topics to be covered include the Visual Artists Rights Act of 1990 and the California Art Preservation Act. Mr. Zohar will draw from his experience in representing artists Mear One, Chor Boogie and Shark Toof against AEG regarding the destruction of his clients’ art.


    Presenter:

    Daniel Y. Zohar is the founder of the Zohar Law Firm, P.C. in Los Angeles. He is a graduate of Duke University (1990) and UCLA School of Law (1993). He focuses his trial practice in the areas of contingency business litigation/business torts and consumer rights. He was inducted into the American Board of Trial Advocates (ABOTA) and has been a Board Member of both the Consumer Attorneys Association of Los Angeles and the Association of Business Trial Lawyers. Mr. Zohar is an adjunct professor at the UCLA School of Law. He is a Martindale Hubbell AV Peer Review Rated attorney who has been recognized the last eleven years in Los Angeles Magazine as one of Southern California's Super Lawyers.

    Abe Carnow is very active in tax practice and tax education. As a nationwide lecturer for Gear Up Tax Seminars, Abe teaches other accountants about individual income taxation, business income taxation, and ethics. In his tax practice, Abe works with a variety of professionals, including graphic artists, performers, and other service professionals. From 1974-1990, Abe worked for the Internal Revenue Service, in the examination and appeals divisions. Abe has been presenting C.L.A.'s annual tax workshop for artists in Los Angeles since 1993.

    How To Prepare & Present Your Small Claims Case

    With Paul Slavit, Esq.

    This program will provide practical information concerning the effective use of small claims court. Attendees will learn about the uses and limitations of small claims court and available resources when preparing to file a claim. The program will provide information helpful in filing the claim, such as: preparing the case, developing a case outline, organizing evidence and demonstrative materials for the court and applying best practices for presenting the case at trial. In addition, the presenter will address important pretrial dispute resolution alternatives.

    Presenter:
    Commissioner Paul Slavit, served as a court commissioner in the San Francisco Superior Court for ten years, and continues to serve on assignment as a retired commissioner in Alameda County. He has more than three years on the bench exclusively as a small claims court commissioner. He will draw on that experience, as well as his 25 years of private law practice, to give a judicial officer’s observations and advice on the most effective methods in small claims cases.
