Rights Clearance and Insurance for Filmmakers

Production of programming - whether it be a theatrical feature, scripted or reality television series, or even digital short - requires careful attention to legal considerations even before the start of pre-production. Without doing all the required footwork in the legal clearance process and without obtaining the necessary types of insurance, precious production time and thousands or even millions of dollars may be wasted. Worse, the release of the program could be blocked or some or all of the program's financial return could be drained away through nasty litigation. This workshop will give practical guidance as to the policies and procedures that should be followed to ensure a smooth production that avoids infringement of third-party rights, and as to what is involved in applying for and obtaining necessary types of insurance policies.

Roger Kaplan (Roger J. Kaplan, a Professional Corporation) provides legal and business affairs consulting services focused on the entertainment and related industries, handling all types of dealmaking and contract negotiation, production, distribution, rights clearance and other non-litigation matters for individual talent as well as production companies and studios. Roger represents clients in all creative fields, including television, film, digital media, merchandising, games, software, book publishing, music and the visual arts. Roger launched his law practice in 2010, after nearly 20 years working as a legal and business affairs executive at the major studios, most recently as Vice President of Legal Affairs at NBC Universal. Roger’s responsibilities at the studios spanned all aspects of network, cable and syndicated television acquisition, development, production, publicity, distribution and ancillary exploitation.

Jennifer Kennedy's practice focuses on the needs of artists and creative professionals in a variety of fields, including music, film, literature, and visual arts - as well as where those fields intersect, such as with documentary films about musicians or the transformation of a book into a cable TV series. Before opening Kennedy Law LLP, Jennifer litigated on behalf of some of the world's biggest companies, including more than half a decade of insurance recovery litigation. With her long history of litigating the interpretation of contracts, Jennifer is uniquely suited to provide insight and guidance on the myriad of contracts her clients encounter in the entertainment industry.
