Online Marketing Law for Filmmakers

Social media and online marketing have been with us for almost a decade, but you’d think that websites and online marketers were still cowboys in the Wild Wild West. The FTC and state attorneys general are on the lookout for websites that fail to comply with sweepstakes and contest laws and laws related to the collection of personal information. In addition, websites are soliciting user-generated content that can subject them to infringement, defamation and other claims unless they set up their sites in specific ways to gain legal immunity. This very practical workshop will include the basics of how to conduct sweepstakes and contests legally; how to collect User Generated Content without being subjected to claims of copyright infringement, defamation and other claims; and why you should use a custom Terms of Use and Privacy Policy for your site rather than pulling one from another site and what they should include. The workshop will also touch briefly on compliance with the Children’s Online Privacy Protection Act (aka COPPA) and the Controlling the Assault of Non-Solicited Pornography and Marketing Act (aka the CAN SPAM Act).

Anne Moebes is a solo practitioner who provides legal advice in connection with traditional and online promotions and advertising, including FTC and state law compliance for sweepstakes and contests, social media marketing, truth-in-advertising, the FTC’s endorsement guidelines, buzz, stealth and viral marketing, and clearance of online and traditional advertising copy, including intellectual property and publicity rights. Anne drafts custom Terms of Use and Privacy Policies for her clients’ websites, drafts sweepstakes and contest rules and other documentation, and drafts and negotiates all manner of agreements, including new media, online and traditional marketing, advertising and consulting agreements. With over 15 years of legal experience in the entertainment industry, including engagements at Twentieth Century Fox and MGM, Anne most recently served as Vice President of Business and Legal Affairs for Walt Disney Studios Motion Pictures, where she managed the film marketing legal division, including advising high-level executives in all of the above matters and closing numerous agreements with high-profile companies, e.g., Fandango, Yahoo, Facebook, Apple, Amazon and Major League Baseball.
