Art and Merchandising

Program Description
Clothing, posters, pillows, candles, keychains, stickers, dolls - the list of merchandise items is long, varied, and represents a major revenue stream for artists and rights holders. Copyrights, trademarks, trade dress, and rights of publicity – these and more are implicated in the wild world of merchandise. What do artists need to know before allowing their work to be used on merchandise? What are the different kinds of agreements that artists can make with merchandisers? Are there ways for artists to enforce their rights if they discover unauthorized use of their work? Join CLA and attorneys Scott Burroughs and Stephen Doniger for a presentation covering the intellectual property and contract issues involved in using visual art on merchandise.

Presenters:
Stephen M. Doniger, Esq. - In his 20 years of practice Mr. Doniger has successfully litigated cases in the federal and state courts of California, New York, Nevada, and South Carolina, and has overseen litigation in foreign jurisdictions including Canada and the United Kingdom through local counsel. He has built a successful practice around business disputes in general and intellectual property in particular for clients in the marketing, fashion, entertainment, real estate and hospitality industries. While his practice includes corporate governance, contract negotiations and disputes, and large tort and injury cases, his core passion is for protecting artist against theft of their creative expression. Mr. Doniger graduated from Brandeis University in 1992 and in 1995 he obtained his law degree from the University of Southern California.

Scott Alan Burroughs, Esq. - Mr. Burroughs is passionate about protecting the rights of artists and content creators, and writes and speaks often on the subject. He has handled over a thousand art and business law disputes in his decade of practice – more than virtually any other attorney in the United States. His matters involve fashion, art, photography, scripted and reality programming, accessories, literature, documentary and feature films, websites, advertising, novelty goods, jewelry, hospitality, and home décor. He earned his Bachelor of Arts at the University of California, San Diego and his Juris Doctorate from the University of Southern California.
